INTRODUCTION
Mexam Mailbox LLC (MMB) operates under the permission of the United States postal service and is obliged to cancel service and/or notify the corresponding authorities in case consignee does not comply with the legal requirements or commercial conditions of use. All users of the physical address of MMB are subject to the terms of use.

LEGAL REQUIREMENT (USPS 1583)
Any consignee/person/entity using the MMB address must comply with signing the U.S. postal service’s USPS 1583 form, which requires the consignee to present two (2) official forms of identification at MMB’s representative presence. At least 1 of the 2 identifications submitted must include the residential address of the consignee. See documents section for more detail.
Company names or any other DBA or aliases etc. are considered consignees and must also comply with being included in form 1583 of the natural person representing them.
Copies of form 1583 and consignee IDs are sent to the U.S. postal service. The information contained in Form 1583 is for the sole use of the U.S. Postal Service. If required, MMB is required to share information with U.S. government public safety agencies, in coordination with the post inspector’s office.
It is mandatory to use the PMB number (Prívate Mailbox) assigned to each consignee and use the correct format.

The MMB address is a physical commercial address (it is not PO BOX) and can only be used as an address for poc receipt purposes such as “Shipping Address” or “Mailing Address”.
It is strictly forbidden to use the address as a residential type, “Home Address”, employment address “Work Address” or operational business address.
COMMERCIAL CONDITIONS OF USE
The Mailbox Service offered by MMB is prepaid. It is the customer’s responsibility to keep their service always paid for. The level of service, price, term of the contract and authorized consignees is defined on the receipt and can be consulted on the online customer portal. Service is non-refundable. Service is billed according to predefined plans which observe limits of pounds received and warehouse.
Only holders and their consignees previously registered in the MMB system can make use of the address. Providing, reselling, subleting or otherwise extending MMB’s services to third parties will result in additional charges, denial of POC delivery and/or cancellation of service without refund.
Bypassing previous section with the use of combined names, references, numbers, or codes including “c/o” (in care of) added to the names of consignees or address in general will result in additional charges denial of delivery of POC and / or cancellation of service without the right to refund.
MMB maintains several promotions and discounts available to new customers recommended by existing customers. Customer is invited to recommend service to third parties instead of sharing the PMB.
Use of the address is not limited to the physical receipt of POC. Presenting MMB’ s address for any procedure, account opening, commercial transaction etc., even if it only happens once it amounts to use of the address. Activating paperless services to avoid receipt of statements constitutes use of the service and is subject to the applicable terms of use and charges.
Account holder is responsible for transmitting the terms of use to its consignees and that they comply with the terms of use.
SCOPE OF SERVICE
Customer (Holder) is assigned (i) an account, (ii) a business physical address and (iii) a PMB number (Private Mailbox). Holder authorizes MMB and its employees to act as their agent for purposes of receiving, storing, and delivering POC on behalf of the holder and its registered consignees.
MMB does not offer courier, transfer, import or export services between Mexico and the United States. MMB is not a long-term warehouse service, nor does it have facilities or industrial equipment for handling heavy loads. The service is focused on handheld POC (less than 40 pounds per package). High volume or high weight POC is subject to additional charges. Using the MMB office phone number is not part of the service. MMB is not secretarial service, calls received for clients will not be answered.
SHARING PMB:
The address and PMB can be shared by the holder with his/her immediate family defined as: Spouse and minor children living in the same residence. For all other kinships and friendships (including minors) it is only allowed to share with two (2) people at no additional cost. The total number of consignees in a PMB may not exceed six (6) persons.
Any consignee who shares a PMB with other consignees authorizes by default all other consignees to withdraw their POC. It also authorizes third-party agents added by the holder to withdraw their POC.
MINORS (from 1 day to 18 years)
Minors may make use of the address and service only if one or both parents are the holder or consignee of an active account but comply with the documentation requirement and form 1583.
MMB extends a maximum grace period of six (6) months to minors who reach the age of majority (18 years),to obtain official identifications and process the form USPS 1583.
MMB reserves the right to require birth certificate of minors to validate parents’ names. MMB will report suspected child identity theft to appropriate authorities.
POC DELIVERY
MMB guarantees to deliver POC to the customer in the same or better condition that was received.
MMB reserves the right to ask for photo identification from anyone attempting to remove POC from the premises. POC is only given to persons who are active account holders or consignees who meet USPS 1583 requirements or are explicitly authorized in writing by the account holder (Agents).
Client is not required to withdraw their entire POC in a single visit but withdrawing POC selected by consignee name or tracking number number may result in additional charges. Only Account Holders present at MMB facilities have the right to withdraw selected POC.
It is the responsibility of the person picking up POC to know what they are picking up. Be it the tracking numbers, size, value or quantity of the packages. MMB does not assist in “picking “what to take. Selective Picking is not guaranteed and is done at the discretion and time availability of the customer service agent. Restocking fees may apply if POC made available for pick up is not taken.
Consignees, people, or any other person who is not the Account Holder attempting to remove selected POC may result in additional charges.
MMB reserves the right to deny service and access to the facilities to any person (customers, consignees or their agents) who cannot observe the decorum of the office.
POC AVAILABILITY
POC is available to pick up only at the main office in El Paso, Texas within set business days and hours. MMB observes U.S. holidays and reserves the right to close or limit service on such days. Holidays and schedules are published on our page www.mexambox.com/calendar MMB does not use traditional physical mailboxes with door and 24-hour access key.
MMB guarantees all POC is available to be withdrawn no later than the end of the next business day that was received. MM requires at least four (4) business hours to withdraw POC with tracking number. Eight (8) working hours are requested to withdraw letters and documents without tracking numbers. During the last six (6) weeks of the year two (2) additional hours are requested after being received.
The service does not guarantee immediate POC availability, therefore it should not be used to sustain operations of an urgent or critical nature.
MMB reserves the right to refuse delivery of POC:
- to persons not previously authorized by the account holder.
- to accounts with outstanding balance.
- to consignees who do not comply with USPS Form 1583.
- to minors.
- to accounts with USPS 1583 forms yet to be completed.
- to expired contracts.
- of undocumented children with USPS Form 1583.
- in non-working days / hours.
POC STORAGE
The mailbox service includes limited free storage. MMB measures storage usage as Daily Warehouse Points or (PDA) where one (1) PDA equals one (1) pound of POC stored for one (1) day. PDA is evaluated each calendar month regardless of the start or end date of the contract.
Each service plan includes a limit of points per month. Unused points are carried over up to 6 calendar months regardless of end of contract. The limit of points available in the account will result in a storage charge at the price indicated in the price table.
POC is stored in the same facility that is received and delivered. (The address). Facilities are maintained with artificial climate protected from environmental elements.
The client and its consignees authorize MMB to open, inspect or repackage POC when they deem it necessary for the purposes of:
- Identify the Consignee
- Physical and environmental security (real and perceived)
- Consolidation of space.
- Damaged original packaging
POC RECEIPT
MMB has no influence over U.S. mail operations or private couriers such as UPS or FEDEX. The availability of POCs depends on the delivery time of those couriers.
MMB can only receive POC during business hours and is not responsible for POC left out of our facilities at will.
All packages received are weighed and recorded electronically using commercial digital equipment with definition of a decimas of pound.
Minimum weight applied:
- Envelope #10: 0.07 pounds.
- Postcards: 0.01 Pounds
- Magazines and Catalogues: £0.20
- Packs: 0.25 pounds
A label is applied to a POC containing the PMB, POC registration number, consignee’s name and other information for inventory control purposes. In the absence of a POC label it is identified with pen on the envelopes and permanent marker on the packages.
MMB does not receive POCs with the following characteristics:
- That violate U.S. laws, Texas or Postal Regulations.
- That require special equipment to move. (e.g. Pallet Jack)
- Weighing more than 100 pounds (45 Kilos).
- With dimension greater than 1 cubic meter
- With dimension greater than 2 linear meters.
- Pallets, Pallets or Wood Packaging of any weight or dimension.
- Furniture or Automobiles.
- Delivered by heavy cargo carriers requiring high door.
- Delivered by individuals/individuals not affiliated with a recognized company.
MMB reserves the right to deny POC that contains:
- Organic or Biological Substances (animals, plants, etc.).
- Material requiring refrigeration.
- Material that exudes odor or liquid.
- Alcohol
- Firearms, bladed weapons or their components and derivatives.
- Explosives or their components.
- Dangerous or noxious substances.
- Flame substances.
HIGH VOLUME POC
Packages in excess of 40 pounds and/or a linear dimension greater than 24 inches are considered High Volume and are subject to additional charges upon receipt. See additional chargessection. Each service level defines the number of high-volume packages that are allowed to be received without additional charge.
UNKNOWN POC
MMB reserves the right to refuse POCs from unregistered consignees or those associated with an active account.
POC received in MMB where the name / alias / company / entity etc. of the consignee does not exist assigned to an account and active service, is considered POC Unknown. This applies inclusive to POC with PMB number on the label.
Unknown POC is detained by MMB until the consignee is identified and assigned to an active account (whether existing or new). Delivery of poc occurs only after the unknown consignee complies with the terms and conditions applicable to all users of the service, in addition to applicable charges. Adding consignees to an account can result in additional charges. (See section additional charges).
Unknown POC is stored for thirty (30) days maximum from being received. Ttime of storage of the unknown POC begins from being received in MMB and once assigned account, can trigger storage charges according to the storage rules (see warehouse section).
MMB reserves the right to dispose of the unknown POC not claimed within thirty (30) days and is absolved of any obligation of delivery to the consignee.
UNKNOWN POC “First Class”
POC Unknown First Class that exceeds 30 days of storage without being claimed will be marked “RTS” return to sender with the legend “FRAUD, user not authorized to use this address”. (Fraud, user not authorized to use this address) and will be returned to the postal service for return to the sender. MMB is not responsible for any consequences caused by this event. “First Class” is a USPS service level that gives legal protection to the submitted document.
UNDEFINED POC
POC received where the consignee cannot be defined is considered An UNDEFINED POC. UNDEFINED POC will be stored for a maximum of 30 days. If it is not claimed within 30 days, MMB reserves the right to dispose of the indefinite POC.
MMB is not responsible for poc abandoned for this reason. It is the consignee’s responsibility to ensure their parcel is assigned to their mailbox. (See communication section).
Reassignment of Indefinite POC to a registered consignee may be initiated by the client or MMB, and the final decision is at the discretion of MMB and its agents. MMB reserves the right to request various evidence from the client to claim an indefinite POC which may include verification of the POC content.
Factors contributing to the lack of definition of consignee:
- Lack of #PMB in the label and the name matches more than 1 customer.
- Corrupted/unreadable label.
- Abbreviated label used by delivery services that use only initials.
DAMAGED / EMPTY POC
MMB is not responsible for POC received damaged or empty.
MMB receives POC daily in high volume batches. It is common for POC to arrive on mail bags without visibility of the interior. For this uncontrollable fact, POC is not rejected or inspected for damages at the time of delivery.
Only a general inspection is performed to identify POC with potential for damage. MMB can only report these POCs to the driver/postman making the delivery but cannot guarantee the POC will be identified as such by couriers.
During the receipt and documentation process, if the POC appears to be damaged, opened or not contained, it will be identified as “Damaged” or “Open” in the electronic record, visible to the customer on the online customer portal.
If the customer wishes to initiate a claim with the seller, the customer is entitled to receive images of the POC already stored. Security camera images at the time of receipt are also available, but not guaranteed.
IMPORTANT to note that claims of damaged packages can only be initiated by the customer, (not MMB) and only directed to the seller /store / supplier making the shipment. Since they are the customers of the couriers and the only ones who can claim them.
SERVICE MANAGEMENT
CHANGES TO THE SERVICE
Customer has the right to make changes to their account at any time. Certain changes may incur additional charges. (See additional charges section).
Requisitions of changes will only be accepted from the account holder and only in person directly at MMB facilities or through their email registered to the account. (See communication section). Attending agents reserve the right to verify the identity of the client via official identification.
It is the customer’s responsibility to obtain a copy of the physical or digital receipt to check for changes to the account.
Adding consignees to an account may result in additional charges if the account exceeds the number of free consignees allowed in the service.
MMB reserves the right to make changes to service levels that may result in debits or credits to the customer’s account. Changes include changing service level, adding consignees, adding additional charges and applying discounts.
Cancellation of Consignee. MMB reserves the right to request proof of change of address from consignees who unsubscribe and have recently received “First Class” correspondence from financial institutions such as Bancos, Federal or State Government Agencies, such as “Internal Revenue Service” and other entities. Pod Unknown First-Class status will be applied to correspondence received for a decommissioned consignee.
RENEWAL OF SERVICE
Annual contracts will be automatically renewed at the end of their validity, unless the customer expressly requests cancellation. MMB does not store credit card information and does not make self-payments. It is the customer’s responsibility to settle the renewal within 30 days of the start of the new contract or first delivery whichever comes first. Contracts not settled within 30 days will be cancelled.
CANCELLATION OF SERVICE
Service may be cancelled by customer address at any time. MMB does not make full or partial monetary refunds for unused time or pounds. All services are prepaid annually.
MMB reserves the right to cancel service on the grounds of
- Breach of terms of use (by owner, consignee or agent).
- Lack of response to communications.
- Non-payment.
- Court order from the American postal service or government agency.
It is the responsibility of the customer and its consignees to change their address with each of their senders. MMB is not responsible for POC received after the cancellation of service is for any reason.
IMPORTANT: the American postal service has a service called “Mail Forwarding” or mail advance to another address. This service DOES NOT APPLY to redirect mail out of a CMRA such as MMB. You can redirect from another direction to MMB, but not from MMB to another address.
POC in store of cancelled services is considered abandoned by the client. MMB reserves the right to discard any abandoned POC.
LIMITATION OF LIABILITY
MMB is responsible for poc from its clients only from receiving it at its offices in El Paso, Texas until delivery to the customer or their representative.
Claims for parcels damaged or lost by MMB only apply to parcels addressed to names of registered consignees, with the PMB on the label, with acknowledgement of receipt, electronic guide number and detailed invoice that relates to the acknowledgment of receipt. Maximum time to claim danos is 30 days after package being received at MMB.
In case of loss or damage caused by MMB. The customer agrees to offer MMB minimum two (2) weeks to locate or replace lost merchandise. MMB accepts a maximum liability of $100.00 per package. MMB does not make monetary refunds. Liability is limited to the value of the lost or damaged merchandise, MMB is not responsible for consequences arising from loss or damage of POC.
COMMUNICATION
MMB uses the website www.mexambox.com and email of the domain @mexambox.com for exchange of communication with the client. The lack of internet access and/or an email may interfere with communications between MMB and Client. For reasons of customer privacy and MMB security, MMB does not report or take addresses via telephone.
The website www.mexambox.com is dynamic and occasionally changes format and content, but always has basic information of the client and its service including: PMB and address, term of contract, names of consignees and their status 1583, contracted service with its weight and warehouse limitations, Time and Weight used and POC in warehouse available to be withdrawn.
Currently the www.mexambox.com page only allows you to give one (1) only electronic access to the customer portal. Client can share access with their consignees, but everyone who has access to the portal will be able to see the information of the otherconsignees in the PMB including current and historical POC inventory.
All communication regarding Renewals, Consignees, Delivery Authorizations, Inventory, requisitions and questions in general will be made by email, being the only email of the Holder of the PMB to which information will be answered. MMB does not respond to unknown emails not expressly part of the PMB profile.
It is highly recommended not to use a business email, or general use email from more than one person. It is also recommended to register the domain @mexambox.com as “secure” in your email service.
Occasionally MMB sends electronic notifications of Renewals, Collection, Excess Storage and general notices. The expectation is that the PMB holder will have access to your email to stay up to date with communications.
Customer email is used only for communications relevant to and concerning customer service and MMB in general. And it is not used for any kind of marketing external to MMB. MMB does not share personal information of customers or consignees to third parties except the U.S. postal service (which does not include email)
In case of discrepancies between the content of the website and the internal system of MMB, the internal system of MMB will predominate. The client is advised to require a physical or digital copy of their contract at the time of contracting, renewing or making payments.

Exceeding the weight limit to the contracted service will result in automatically increasing the level of service to the most appropriate based on current and estimated annual usage. Customer is responsible for settling the price difference.
Plans exceeding 1440 pounds per year are quoted individually.

MMB guarantees the same scheme of plans and prices for at least 2 consecutive contracts per year.

ENTITY MEXAM MAILBOX LLC
ARBITRATION
Any controversy or claim arising out of or relating to this agreement, or breach thereof, shall be resolved by arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules [or others], and judgment on the award rendered by the arbitrator. (s) may be entered in any court having jurisdiction over them. In the event that MMB is not in breach or at fault, you agree to reimburse MMB for the costs associated with the arbitration case and the arbitration costs.
FORCE MAJEURE
MMB shall not be liable for any breach or delay in the performance of its obligations under this Agreement arising from any of the following causes, to the extent beyond its reasonable control: acts of God, accidents, riots, war, terrorist acts, epidemics, pandemic, quarantine, civil commotion, breakdown of communication facilities, breakdown of web hosting provider, breakdown of internet service provider, natural disasters, governmental acts or omissions, changes in laws or regulations, national strikes, fires, explosions, widespread unavailability of crude materials or energy.
For the avoidance of doubt, Force Majeure shall not include (a) financial difficulties or the inability of either party to make a profit or avoid financial loss.
CHANGE OF TERMS.
MMB reserves the right to update and change this agreement as permitted by applicable law. This may include updating prices and rates. Change, add or delete general conditions of use. We may do this in response to a legal, commercial, competitive or other reason not listed here. MMB will notify the customer if they have the right to reject a change.
COMMERCIAL PHYSICAL ADDRESS
MMB facilities where POC is received and operates, do not belong to MMB and are rented facilities. MMB currently has a long-term lease expiring On December 31, 2023, with the entity “Astro GatewayLLC” owners of the property where MMB operates. “Astro Gateway LLC” has the right not to renew a tenant contract if it deems it appropriate.
MMB management will make every effort not to make changes to the address but cannot guarantee your stay any longer in advance of the expiration of the tenant contract, therefore, MMB reserves the right tochange the address of its offices and branches when it deems it prudent.
In rare cases of exercising the change of address, MMB will notify its customers by the previously defined means of communication with the maximum possible time in advance. Once a new address is established and it can operate it will be communicated. It is the customer’s responsibility to update their address with all their senders, sellers, payment services etc. toensure your POC is sent to the new address. The window to transition from a non-exedra address 3 months. Once the above address is closed, MMB is not responsible for POC sent there.
BANKRUPTCY
This Agreement shall terminate, without notice, (i) when the institution by or against any of the parties to the insolvency, receivership or bankruptcy proceedings or any other proceeding for the settlement of the debts of either party, (ii) when either party makes an assignment for the benefit of creditors, or (iii) by the dissolution or cessation of commercial activities of either party.
